I. General provisions of tourist guide course

§1

§2

The terms used in these Regulations shall have the following meanings:

  1. Registration Form – a questionnaire completed by the User during the registration process on the Platform.
  2. Password – a string of characters, defined by the user or generated by the Platform in the password recovery process.
  3. Username (Login) – unique User identifier defined by the User during the registration process.
  4. Login – confirmation of the identity of the registered User by entering a username and password.
  5. TouristCourses.com – course owner
  6. Platform – a virtual educational platform available via the Internet at TouristCourses.com
  7. User – a person using the Platform.
  8. Registered User – a user who has completed the registration form, thereby concluding an Agreement with TouristCourses.com, and who has access to the broader content of the Platform.
  9. User Profile – a standard set of User data provided by the User during the registration process.
  10. Training company – a company that provides its own courses on the Moodle platform .
  11. Organizer – a training company organizing a given course and thus taking legal and financial responsibility for the proper service of its participants.
  12. Trainer – a private person conducting courses.

II. Use of the Service

§3

  1. The course on TouristCourses.com is available to any Internet user who is of legal age, has at least secondary education, has appropriate health conditions and is not a person with a criminal record. Persons with a criminal record cannot participate in this course.
  2. Access to the TouristCourses.com course is subject to payment.
  3. TouristCourses.com course may be partially free, but information provided free of charge may require a password and other data.
  4. By starting to use the TouristCourses.com course , the user acknowledges and accepts the terms of these Regulations.
  5. TouristCourses.com course is available no earlier than the moment the payment is credited to the payment system account.
  6. Any comments regarding the quality of the TouristCourses.com course should be directed to the Course Organizer, i.e. TouristCourses.com.
  7. Any claims related to the quality of a TouristCourses.com course should be directed to the Course Organizer, i.e. TouristCourses.com.
  8. Access to the TouristCourses.com course is only available to people who meet all of the following restrictions:
  9. are an adult (over 18 years old),
  10. have at least secondary education,
  11. people with appropriate health conditions,
  12. I have no criminal record and there are no criminal proceedings pending against me,
  13. We rely on Polish law and the proceedings are entirely based on it.
  14. We do not know the foreign and local laws, therefore we cannot guarantee that this course will be recognized in your country. The user must check it for themselves.
  15. Poland is a member of the EU, so theoretically this course should be recognized in EU countries. However, we cannot assure you of this.
  16. Before you sign up and pay for this course, please find out and make sure it is recognized and honored in your country. You make this decision at your own risk.
  17. The course is conducted entirely and exclusively in English and concerns the history of Poland and its realities.
  18. By registering for this course, you accept all the above conditions and possible risks regarding the validity of this course in your country. Make an informed, considered and responsible decision.
  19. In accordance with Polish law, you have 14 days to withdraw from this contract (counting from the date of receipt of the transfer to the Organizer’s bank account).

§4

  1. Using most course resources on TouristCourses.com requires logging in.
  2. The free version of the course on TouristCourses.com allows people who do not have an account on the platform to log in – “Demo”.
  3. TouristCourses.com course is paid. Its price includes tuition, issuing 1 certificate and one User ID.
  4. Additional fees may be charged for each subsequent sending of a certificate and ID, etc. to the User or other additional activities performed by the Organizer on behalf of the User.
  5. If the User does not complete the course (theoretical classes) before the course end date, his/her payment will be forfeited and non-refundable.
  6. If the User does not complete the course (theoretical classes) before the course end date, he or she may extend it for a fee.

§5

TouristCourses.com course User registration includes:

  1. accepting the terms and conditions of the TouristCourses.com course regulations,
  2. correct completion of the TouristCourses.com course Registration Form ,
  3. confirmation of registration of the TouristCourses.com course by opening a special link in the web browser sent by the Platform after registration. The User gains full access to the TouristCourses.com course after correctly confirming the registration process and logging in to the Platform.
  4. A registered User may modify his/her data contained in the User Profile at any time.

§6

By submitting the Registration Form for the TouristCourses.com course , the User confirms the authenticity and accuracy of the data contained therein and agrees to the provisions of these Regulations, recognizing their binding nature.

§7

  1. The course organizer TouristCourses.com reserves the right to refuse to register a user.
  2. The course organizer TouristCourses.com reserves the right to block the account of a user who violates the provisions of these Regulations. In such a case, the user is not entitled to compensation for the lack of access to the paid TouristCourses.com course .
  3. The account may be unblocked after a written declaration of compliance with the Regulations.
  4. It is strictly forbidden to share passwords or other confidential information between TouristCourses.com course participants . Such actions may result in removal from the TouristCourses.com course without refund of the money paid.
  5. If it is determined that the student has not read the entire course material (e.g., only solved the tests), then such actions will be considered as an attempt to cheat. Such actions may result in removal from the TouristCourses.com course without a refund of the money paid.
  6. Course TouristCourses.com is an online course . Therefore, all learning must take place online ( not offline ).
  7. It is prohibited to open files in more than 1 tab (window) at a time for so-called caching.
  8. Each student learns from their own account. If more than one person uses one computer, then they must use the course one by one (alternately) after logging in to their account.
  9. In order to successfully complete the course, you must meet two conditions: successfully complete all tests, and thoroughly read each course file (applies to every student),
  10. If a student fails to attend online classes , such action may result in failure to pass the TouristCourses.com course without a refund of the money paid.
  11. You should study according to the following scheme: lesson 1 -> test 1, lesson 2 -> test 2, lesson 3 -> test 3, etc.
  12. The so-called “green checkmarks” only mean that the file was only opened. It does not mean that the file was listened to or viewed in its entirety.
  13. Each student must thoroughly familiarize themselves with each course file (read, listen to, or watch each file from beginning to end). The exceptions are the so-called “help” files, which are not mandatory.
  14. The activity of each student (logs) is checked by the Organizer at the end of the course.
  15. In the event of a repeated violation of the TouristCourses.com Course Regulations despite a written declaration, it will not be possible to unblock the account and the User will not be entitled to claim compensation for the lack of access to TouristCourses.com.
  16. Refusal to register or blocking of a user account for a TouristCourses.com course results in blocking the User’s access to the Platform, with the exception of publicly accessible parts.

§8

  1. The course organizer TouristCourses.com undertakes to use the data provided by the User only for the purpose for which they were made available and not to disclose them to third parties, unless generally applicable regulations provide otherwise.
  2. An exception to paragraph 1 is the right of the TouristCourses.com Course Organizer to process User data for marketing purposes, including sending commercial information to the user’s e-mail address, mobile phone number or residential address.
  3. The User may block the receipt of information by e-mail in his/her User Profile.
  4. Regardless of the above provisions, the User consents to TouristCourses.com making the above-mentioned information available to entities cooperating with TouristCourses.com for the purpose of proper provision of services. The provisions of paragraph 1 shall apply accordingly to these entities.

§9

The User has the right to unregister from the TouristCourses.com course user database by sending an email with the following content:
“Please unregister me from the TouristCourses.com user database . By submitting this decision, I am aware that I will not be able to receive my login again and that removing me from the database is irreversible and results in loss of access to the paid TouristCourses.com online course .”

III. User Obligations

§10

  1. When using the TouristCourses.com course , the User is obliged to comply with the provisions of these Regulations, generally applicable provisions of Polish law and customs adopted in the use of the Internet.
  2. In particular, the publication of indecent, offensive and obscene content as well as Internet practices generally accepted as reprehensible are considered a violation of these Regulations.
  3. Any action inconsistent with the indicated regulations gives rise to the User’s liability and the obligation to repair the damage in accordance with general principles.

§11

  1. The User acknowledges that all information relevant to the operation of the TouristCourses.com course will be made available on the Platform’s pages and will be deemed to have been correctly provided to him/her.
  2. The user should inform TouristCourses.com about changes to the data provided for the TouristCourses.com course during registration.

IV. Technical disclaimers

§12

  1. The course organizer on TouristCourses.com does not guarantee that information sent via the Internet will reach the user in an error-free, complete and full form.
  2. The course organizer on TouristCourses.com is not responsible for damage caused by malfunction of the transmission system, including equipment failures, delays and disruptions in the transmission of information.
  3. If required by security or other reasons beyond the control of the TouristCourses.com course Organizer , they may temporarily limit access to the TouristCourses.com course for the period required to remove the reasons for the lack of access. In such a case, the TouristCourses.com course Organizer is not responsible for any limitations in the availability of the TouristCourses.com course .
  4. Hardware requirements: sound card, speakers, operating system: Windows 98, 2000, NT, Me, XP, Vista, 7,10,11 or newer. Minimum screen settings requirements are 800×600 pixels. TouristCourses.com course works for browsers: Mozilla Firefox , Chrome, Opera.

V. Final provisions

§13

Registered Users of the TouristCourses.com course consent to the sending of information and messages via e-mail and digital telephony and recognize them as effectively delivered.

§14

  1. Any changes to the Regulations introduced by the Organiser of the TouristCourses.com course will be posted on the Platform.
  2. Changes to the Regulations are binding after 14 days for registered users and from the moment of their posting in the TouristCourses.com course for other users.

§15

The rights and obligations of the User are not transferable to a third party without the prior written consent of the Organizer of the TouristCourses.com course .

§16

The Regulations will be interpreted in accordance with generally applicable Polish law.

§17

  1. Any disputes with the Organiser of the TouristCourses.com course arising in connection with the operation of the Platform will be resolved by the Common Court in Głogów.
  2. Disputes between users and course organizers will be resolved by the General Court in Głogów

§18

The course organizer TouristCourses.com may conclude separate agreements with Training Companies and Trainers, the provisions of which take precedence over these regulations.

§19

Integral parts of these Regulations are:

  1. Privacy Policy
  2. Legal disclaimers
  3. Protection of consumer rights
