Protection of consumer rights.

Rights and obligations of the Seller and the Buyer.

I. General provisions

  1. The following document and provisions are consistent with the Consumer Rights Act of 30 May 2014, Journal of Laws 2014, item 827, and are effective from 25 December 2014, with subsequent amendments.
  2. The Buyer is any person purchasing any online course, hereinafter referred to as the Course Participant. The website that is superior to other websites of individual courses is: https://www.TouristCourses.com .
  3. Any additional explanations can be found in the regulations: TouristCourses.com.
  4. The TouristCourses.com copyright is placed on the TouristCourses.com website.
  5. The regulations and cookie policy are available on TouristCourses.com.

II. Offer – Products and services available on the website.

  1. Goods or services sold by the Seller:
  1. are the property of the Seller. The Seller has the copyright or license rights to most of them. The Seller has the written right to use and resell the remaining content;
  2. the sale of courses does not violate applicable law;
  3. all courses are described in detail and presented on the individual course websites;

  5. The Seller sells digital content. Therefore, they are obliged to inform the Student about the hardware requirements and functionality of the digital content.

III. Price

  1. The price of the course is specified in the “Register for the course” field. This is the gross and total price.
  2. The course price may change during individual sales seasons.
  3. The course participant is bound by the course price specified when placing an order for a specific course.
  4. The seller may grant sales discounts. The seller independently determines their size, when, how and to whom they grant them.

IV. Specification of the form of order fulfillment:

  1. The student independently chooses the course that interests him/her.
  2. The course participant independently familiarizes himself/herself with the offer of a given course, with the rules of participation in it and with legal requirements.
  3. The student independently chooses the course date that suits him or her.
  4. The student independently clicks on the selected field “Register for the course”.
  5. The student re-acquaints himself/herself with the rules and requirements of the given course.
  6. On the website www.ekademia.pl, one orders the selected course by filling in the required fields and clicking the “Order” button.
  7. The student independently selects the form of payment through the payment system. The student can also make a bank transfer directly to the Seller’s bank account:

    in the transfer title, providing your name and surname, the selected rate and e-mail address. Example title transfer : your name and surname, your e-mail address, PT22.
    After the payment for the selected course has been posted, the Student receives an e-mail with a login, password and a link to the paid course. Only then can he/she start learning.
  8. The deadline for posting the payment depends on the bank where the student makes the payment for the course.

V. Order fulfillment method:

  1. Certificates are sent after the student completes the course.
  2. Certificates and certificates are sent by regular mail delivered by Poczta Polska. The course participant can choose another form of sending the letter (additional fee). The delivery time depends entirely on Poczta Polska. As a rule, it is a few business days.
  3. At the written (e-mail) request of the Course Participant, the Seller may issue and send the certificate more quickly.
  4. Certificates are sent within 3 business days of the course completion by the student.
  5. At the written (e-mail) request of the Student, certificates are sent within 2 business days of receiving the e-mail from the Student.
  6. The Seller may introduce additional fees for sending a certificate or certificate if the Student independently asks the Seller to send and send a shipment other than a regular letter. The amount of the additional fee will then result from the price list of the given transport or courier company.
  7. The costs of distance communication in order to conclude a contract (telephone calls) are specified in the price lists of individual telephone operators. The costs of telephone calls are specified by the telecommunications company to which the Course Participant is a subscriber. The Seller does not earn on these telephone calls.
  8. The costs of distance communication for the purpose of concluding a contract ( Skype and e-mail calls) are completely free.
  9. The Seller may introduce additional fees if the Student:
  1. provided incorrect personal data necessary to issue a certificate and requests its re-issuance,
  2. does not receive postal items and the seller must send them again to the Student,
  3. requests an additional copy of the certificate or its duplicate,
  4. due to the fault of the Student, he did not complete the course within the specified time (specified in the course) and will personally ask the Seller for an additional date to complete the course.

VI. Returns

  1. In accordance with the Consumer Rights Act of 30 May 2014, Journal of Laws 2014, item 827:

Art. 38. The right to withdraw from a contract concluded outside the business premises or at a distance does not apply to the consumer in relation to contracts: 1) for the provision of services, if the entrepreneur has fully performed the service with the express consent of the consumer, who was informed before the commencement of the provision that after the entrepreneur has provided the service, the consumer will lose the right to withdraw from the contract; 13) for the supply of digital content that is not recorded on a tangible medium, if the provision of the service began with the express consent of the consumer before the expiry of the period for withdrawal from the contract and after the entrepreneur informed the consumer about the loss of the right to withdraw from the contract.

The Seller has the right to refuse to refund the money for the course chosen by the Student.

  1. The Seller, applying fair play principles, may refund the money for the course chosen by the Student. If the Student informs the Seller about this within 10 days of purchasing the course.
  2. The Student’s request for a refund must be made exclusively via email. The Student then sends an email to the Seller at the TouristCourses.com email address with the following content:
    “I am asking for a refund for the course. By submitting this decision, I am aware that I will not be able to receive my login and password again and that my removal from the database is irreversible and will result in loss of access to the paid online course. Student’s name and surname.”
  3. The seller may reduce the refund for the course by the value of the commission paid and/or the costs of the bank transfer. However, this is not usually done. As a rule, the seller covers the entire cost of the aforementioned refund.

VII. Complaints

  1. The seller is obligated to deliver the course, certificate or attestation free from defects.
  2. If defects arise due to the fault of the Seller, he shall bear all costs associated with it.
  3. If defects arise due to the fault of the Course Participant, he or she shall bear all costs associated with it.
  4. Any complaints should be sent to the following address: ” Henc i spółka” Paweł Henc with its registered office in 67-200 Głogów at 43b Jedności Robotniczej Street, NIP: 6931333758. or via e-mail.
  5. The deadline for processing complaints is up to 10 business days.
  6. The Seller will inform the Student electronically about the status of his complaint within 10 working days.
  7. If the complaint is justified, the Seller may offer a refund, exchange for a new product or repair it.

VIII. Personal data protection

  1. Data protection in accordance with art. 13 of the GDPR (general regulation on the protection of personal data of 27 April 2016, OJ EU L 119 of 04.05.2016) informs that;
    – personal data will be processed for the purpose of implementing the course on the basis of Art. 6 sec. 1 letter b of the GDPR. – the recipients of personal data will be only entities authorized to obtain personal data on the basis of legal provisions – personal data will be stored until the end of the course and full settlement between the parties.
    – The user has the right to request from the administrator access to personal data, their rectification, deletion or restriction of processing, and to object to processing. The user also has the right to transfer data and to lodge a complaint with the supervisory authority.
  2. Personal Data Administrator – for the purposes of order fulfillment (payment), all personal data of the Course Participant are processed by: PayU SA with its registered office in Poznań, 60-166 Poznań, at ul. Grunwaldzka 182, entered into the register of entrepreneurs maintained by the District Court in Poznań – Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register under the KRS number 0000274399, with the share capital of PLN 4,000,000, fully paid up, and the Tax Identification Number (NIP): 779-23-08-495, REGON 300523444. The Personal Data Protection Principles are specified in the relevant regulations of PayU SA: https://www.payu.pl/pliki-do-pobrania/regulaminy-i-informacje .
  3. Personal Data Administrator – courses and training are conducted on the website www.ekademia.pl , owned by: Majewski Business Consulting Piotr Majewski, ul. Łańcucka 12a/8, 80-809 Gdańsk, NIP: 585-139-26-23. The principles of personal data protection are specified in the relevant regulations of Majewski Business Consulting Piotr Majewski: http://www.ekademia.pl/regulamin.php .
  4. In order to complete the shipment, data may also be transferred to courier companies or Poczta Polska.
  5. The Student’s personal data will be used to complete the order, for marketing purposes, to issue a certificate for possible registration of the Student to the Education Board or other state institution.
  6. All data is encrypted using the Secure Sockets Layer (SSL) protocol for secure transmission of encrypted data streams. Socket Layer ) released by Go Daddy Secure Certification Authority, Inc. , USA, Scottsdale , Arizona.
  7. All databases have been reported to the Inspector General for Personal Data Protection.
  8. Every Course Participant has the right to view their personal data,
  9. Each Course Participant may independently change or delete their personal data by changing their “Profile” at www.ekademia.pl .
  10. Each Student can unsubscribe from the mailing list at any time by clicking the link in each automated message (in the footer of each e-mail).

IX. Order Fulfillment Limitations

  1. The sale of courses is subject to certain restrictions resulting from statutory provisions (the Education System Act) and the Seller’s requirements.
  2. Each student must meet the following requirements:
  1. must be an adult;
  2. must have at least secondary education;
  3. must not have been convicted and no criminal proceedings must be pending against him;
  4. The territorial scope of the courses covers primarily Poland and the European Union. Additionally, orders from all over the world are fulfilled.
